Effective Date: September 16, 2026

1. Definitions and Interpretation

As used in these Terms, the following capitalized terms have the meanings set forth below:

“Customer” (also “you” or “your”): the individual who accesses the Shop or places an Order.

“Effective Date”: the date stated at the top of these Terms, on which they take effect.

“Fulfillment Provider”: the third-party logistics provider that stores inventory, packs Orders, and arranges shipment on behalf of PicsArt.

“Order”: a Customer’s submission of a request to purchase one or more Products through the Shop.

“PicsArt” (also “we,” “us,” or “our”): PicsArt, Inc., a Delaware corporation, located at Optima Onyx Tower, Suite 1103, 1010 South Federal Highway, Hallandale Beach, FL 33009.

“Products”: the physical Picsart-branded merchandise offered for sale through the Shop.

“Shop”: the online merchandise store operated by PicsArt at https://store.picsart.com, hosted on the Shopify platform.

“Shop Privacy Policy”: the privacy policy posted at https://store.picsart.com/policies/privacy-policy.

“Shopify”: Shopify Inc. and its affiliates, which provide the e-commerce platform, checkout, and payment-processing services for the Shop.

“Terms”: these Picsart Shop Terms of Service, including all policies incorporated by reference.

Interpretation rules: (a) section headings are for convenience only and do not affect interpretation; (b) references to a posted policy mean that policy as amended from time to time; (c) references to statutes include successor legislation and regulations; (d) “including” means “including without limitation”; and (e) where a specific posted policy conflicts with these Terms on the subject matter that policy addresses, the specific policy controls on that subject.

2. Acceptance, Scope, and Eligibility

2.1 Assent. By accessing the Shop, browsing its content, creating an account, or submitting an Order, the Customer agrees to be bound by these Terms, and the Shop Privacy Policy (collectively, the “Shop Policies”). If the Customer does not agree, the Customer must not use the Shop or place any Order.

2.2 Scope. These Terms govern the purchase of physical Picsart-branded merchandise through the Shop only. They do not replace, modify, or supersede the Picsart Terms of Use (available at https://picsart.com/terms-of-use/) or any other agreement governing Picsart’s digital products, services, or applications. Where a Customer also uses Picsart’s digital services, the applicable digital-service terms continue to apply independently.

2.3 Eligibility. To place an Order, the Customer must be an individual who has reached the age of majority in the Customer’s jurisdiction of residence. Persons who have not reached the age of majority may not independently enter into these Terms or submit Orders. A parent or legal guardian who has reached the age of majority may place an Order on behalf of a minor; in doing so, the parent or guardian accepts these Terms and assumes full responsibility for the Order and for the minor’s use of any Product received.

2.4 Geographic Restrictions. PicsArt may restrict the availability of the Shop or specific Products to certain jurisdictions at any time. The Customer is responsible for ensuring that the Customer’s Order and receipt of Products comply with all applicable local laws and import requirements.

3. Accounts, Checkout Accuracy, and Security

3.1 Checkout Information. When placing an Order, the Customer must provide accurate, current, and complete billing, shipping, and contact information. The Customer is responsible for reviewing all information before submitting an Order and must promptly update any details that become inaccurate or incomplete.

3.2 Account Credentials. If the Shop permits account creation, the Customer is solely responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under the Customer’s account. The Customer must notify PicsArt promptly at store@picsart.com upon becoming aware of any unauthorized access to or use of the Customer’s account.

3.3 Consequences of Inaccuracy. PicsArt is not liable for non-delivery, delivery delays, or additional costs resulting from inaccurate or incomplete information provided by the Customer at checkout. PicsArt reserves the right to cancel an Order or request verification where submitted information appears inaccurate, incomplete, or fraudulent.

3.4 Suspension and Closure. PicsArt may suspend, restrict, or close a Customer’s account at any time if PicsArt reasonably believes that (a) the account information is materially inaccurate or outdated, (b) the account has been or is being used without authorization, (c) the Customer has violated these Terms, or (d) suspension or closure is required by applicable law. Where practicable and permitted by law, PicsArt will notify the Customer before or promptly after taking such action.

4. Products, Descriptions, Availability, and Errors

4.1 Product Descriptions. PicsArt strives to present accurate descriptions, dimensions, materials, and other details for each Product listed in the Shop. All Product information is provided for general reference and may be updated or corrected at any time without prior notice.

4.2 Color and Sizing Variations. Product images displayed in the Shop are approximate representations only. Actual colors may vary due to monitor settings, lighting conditions, and manufacturing tolerances. Sizing information is provided as a guide; Customers should consult any posted sizing charts before placing an Order.

4.3 Availability and Purchase Limits. All Products are subject to availability. PicsArt may limit the quantity of any Product available for purchase, restrict sales to certain geographic regions, or impose per-Customer or per-Order purchase limits at its discretion. PicsArt reserves the right to discontinue any Product at any time without liability, except with respect to Orders already accepted in accordance with Section 5.

4.4 Errors and Corrections. Despite reasonable efforts, errors may occasionally appear in Product descriptions, images, pricing, or availability information. PicsArt reserves the right to correct any such error at any time, including after an Order has been submitted. If a correction materially affects an accepted Order, PicsArt will notify the Customer and, at the Customer’s election, either fulfill the Order as corrected or cancel the Order and issue a full refund of any amounts already paid. Nothing in this Section 4.4 limits any rights the Customer may have under applicable mandatory consumer law.

5. Orders, Acceptance, Cancellation, and Rejection

5.1 Offer by Customer. Each Order submitted through the Shop constitutes an offer by the Customer to purchase the Products identified in that Order on these Terms. Submission of an Order does not by itself create a binding contract.

5.2 Automated Acknowledgement. Any automated order-confirmation email or on-screen message generated after Order submission is a receipt of the Customer’s offer only and does not constitute acceptance by PicsArt.

5.3 Acceptance. A binding contract for the purchase of Products arises only when PicsArt issues a shipment-confirmation notification to the Customer. Acceptance applies solely to the Products identified in that shipment confirmation; where an Order is fulfilled in multiple shipments, each shipment confirmation creates a separate contract for the Products it covers.

5.4 Right to Reject or Cancel. PicsArt reserves the right, in its sole discretion, to reject, cancel, or limit any Order, in whole or in part, for any of the following reasons:

  • Stock unavailability or insufficient inventory.
  • Errors in Product descriptions, pricing, or other listing information.
  • Suspected or confirmed fraud, unauthorized payment activity, or failed payment verification.
  • Compliance with applicable sanctions, export controls, or anti-fraud screening requirements.
  • Geographic restrictions or delivery to a jurisdiction PicsArt does not serve.
  • Reasonable grounds to believe the Order is intended for unauthorized resale or commercial exploitation.
  • Violation of any per-customer purchase limits or promotional-code restrictions.
  • Any other reason where fulfillment would be unlawful or impracticable.

5.5 Refund of Cancelled Orders. If PicsArt cancels an Order (or any portion thereof) after payment has been collected, PicsArt will refund the amount charged for the cancelled Products, including any associated shipping charges where applicable, using the original payment method. Refund processing times may vary depending on the Customer’s payment provider.

5.6 Customer Cancellation. A Customer may request cancellation of an Order prior to shipment by contacting store@picsart.com with the relevant order number. PicsArt will use reasonable efforts to accommodate such requests but cannot guarantee cancellation once an Order has entered the fulfillment process. Post-shipment cancellation and return rights are governed by Section 8.

6. Prices, Payment, Taxes, Duties, and Promotions

6.1 Prices and Currency. All prices displayed in the Shop are quoted in the currency indicated at checkout. Prices are subject to change at any time before an Order is accepted by PicsArt; however, the price confirmed at the time of Order placement will apply to that Order. PicsArt reserves the right to correct pricing errors in accordance with Section 5.

6.2 Payment Authorization. Payments are processed through Shopify and its payment partners. By submitting an Order, the Customer authorizes the applicable payment provider to charge the designated payment method for the total amount due, including Products, shipping, and any applicable taxes or fees. PicsArt is the seller of record; Shopify and its payment partners act as payment-processing service providers.

6.3 Taxes. Prices may or may not include applicable sales tax, value-added tax, goods and services tax, or similar transaction taxes, depending on the Customer’s jurisdiction. Any such taxes required by law will be calculated and displayed before Order placement where applicable law so requires.

6.4 Customs Duties and Import Fees. Orders shipped internationally may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. Unless the checkout expressly states that such charges are included, the Customer is solely responsible for all duties and import-related fees. PicsArt does not control and cannot predict these charges.

6.5 Promotions and Discount Codes. Promotional offers and discount codes are subject to any conditions stated at the time of the promotion, including expiration dates, product restrictions, and per-customer limits. Codes may not be combined unless expressly permitted, are non-transferable, have no cash value, and may be revoked if obtained or used fraudulently.

6.6 Chargebacks. If a Customer initiates a chargeback or payment dispute, PicsArt reserves the right to suspend the Customer’s account and withhold further Orders pending resolution. PicsArt encourages Customers to contact store@picsart.com before initiating a chargeback so that the matter may be resolved directly.

6.7 Pre-Placement Disclosure. Where applicable law requires that the Customer be shown all charges (including shipping, taxes, and fees) before completing a purchase, PicsArt will ensure such charges are displayed prior to final Order submission.

7. Shipping, Fulfillment, Delivery, and Risk of Loss

7.1 Fulfillment and Origin of Shipment. Orders may be fulfilled, packed, and shipped by a third-party logistics provider located in China. By placing an Order, the Customer acknowledges and consents to fulfillment and shipment from China or such other location as PicsArt may use.

7.2 Delivery Estimates. All delivery dates, transit times, and shipping timeframes displayed in the Shop or in Order confirmations are estimates only and do not constitute guarantees. Actual delivery times may vary due to carrier schedules, customs processing, weather, or other factors outside PicsArt’s reasonable control.

7.3 Split Shipments. PicsArt may ship items within a single Order in multiple packages or shipments. No additional shipping charge will apply solely because of a split shipment.

7.4 Address Accuracy. The Customer is responsible for providing a complete and accurate shipping address at checkout. PicsArt is not liable for delays, non-delivery, or additional costs resulting from an incorrect or incomplete address supplied by the Customer.

7.5 Tracking. Where available, PicsArt will provide shipment tracking information to the Customer via email or the Customer’s account. Tracking updates are provided by the carrier and may not reflect real-time status.

7.6 Customs and Import Delays. International shipments may be subject to customs inspection, import duties, taxes, and fees imposed by the destination country. The Customer is responsible for any such charges unless otherwise stated at checkout. PicsArt is not responsible for delays caused by customs processing.

7.7 Data Sharing for Fulfillment. Customer order details, contact information, and shipping address may be shared with the Fulfillment Provider, logistics partners, customs brokers, and delivery carriers as reasonably necessary to process, ship, and deliver the Order.

7.8 Risk of Loss and Title. Risk of loss and title to Products pass to the Customer upon delivery to the carrier at the point of shipment, except where applicable mandatory consumer law requires risk to pass at a later point (such as upon delivery to the Customer). Nothing in this Section reduces any nonwaivable consumer rights regarding risk of loss.

7.9 Unclaimed and Refused Shipments. If a shipment is refused by the Customer or remains unclaimed and is returned to PicsArt or the Fulfillment Provider, PicsArt may, to the extent permitted by applicable law, deduct actual return shipping and reshipment costs from any refund issued. PicsArt will contact the Customer before disposing of unclaimed goods. Where mandatory consumer law prohibits such deductions, this provision will not apply to the extent of that prohibition.

8. Returns, Refunds, Exchanges, and Cancellation Rights

8.1 Returns and Refunds. Returns, refunds, exchanges, and cancellations are governed by this Section 8 and applicable law. A Customer seeking a return, exchange, or refund must contact store@picsart.com with the Order number and relevant details.

8.2 Defective, Damaged, or Wrong Items. If a Product arrives defective, damaged, or materially different from the confirmed Order, the Customer must notify PicsArt promptly at store@picsart.com, providing the Order number, a description of the issue, and photographic or other reasonable evidence. PicsArt will, in accordance with applicable law, offer a replacement, exchange, or refund as appropriate.

8.3 Cancellation Rights. Where mandatory consumer law grants a right of withdrawal or cooling-off period, those rights apply in full regardless of any other provision of these Terms. Customers located in jurisdictions providing such statutory cancellation rights may exercise them in the manner and within the timeframe prescribed by applicable law.

8.4 Non-Returnable Items. Certain Products may be designated as non-returnable or non-refundable on the applicable product page. Such designations do not limit any mandatory statutory remedy available to the Customer.

8.5 Refund Method. Approved refunds will be issued to the original payment method unless otherwise required by law or agreed in writing. Processing times depend on the Customer’s payment provider and are outside PicsArt’s control.

8.6 Statutory Savings Clause. Nothing in these Terms excludes, limits, or modifies any consumer right or remedy that cannot lawfully be excluded, limited, or modified. Where mandatory consumer protection law provides greater rights than those set out in this Section 8, those mandatory rights prevail.

9. Intellectual Property and Product Use

9.1 Ownership of Intellectual Property. All Picsart names, logos, trademarks, service marks, trade dress, artwork, designs, photography, graphics, text, and other content displayed on or through the Shop (collectively, “Shop IP”) are the property of PicsArt, Inc. or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants the Customer any right, title, or interest in the Shop IP except as expressly stated in Section 9.2.

9.2 Limited Rights in Purchased Products. Purchase of a Product transfers ownership of the physical item only. No license, assignment, or other right in any trademark, design, artwork, or other intellectual property embodied in or applied to the Product is granted, except the right to use the physical item for ordinary personal, non-commercial purposes.

9.3 Restrictions. The Customer shall not: (a) reproduce, modify, or create derivative works of any Shop IP; (b) resell, distribute, or commercially exploit any Product or Shop IP without PicsArt’s prior written consent; or (c) remove, alter, or obscure any proprietary notices on Products or Shop content.

9.4 Product Use and Care. Customers should follow any care or use instructions provided with or on the product listing. PicsArt is not responsible for damage resulting from misuse or failure to follow care instructions.

9.5 Product Safety and Recalls. If PicsArt initiates or is required to conduct a product recall or safety notice, the Customer agrees to cooperate reasonably, including by ceasing use of the affected Product and following return or disposal instructions provided by PicsArt.

10. User-Submitted Content, Reviews, and Prohibited Conduct

10.1 Ownership of Submissions. Customer retains ownership of any reviews, comments, photographs, feedback, or other content (“User Content”) that Customer submits through the Shop.

10.2 License Grant. By submitting User Content, Customer grants PicsArt a nonexclusive, worldwide, royalty-free, fully sublicensable, transferable license to host, display, reproduce, adapt, distribute, and otherwise use such User Content for the purposes of operating, maintaining, and promoting the Shop, in any media now known or later developed, without further notice or compensation.

10.3 Customer Representations. Customer represents and warrants that: (a) Customer is the sole author or has all necessary rights to submit the User Content and grant the license in Section 10.2; (b) the User Content reflects Customer’s genuine experience and honest opinion; (c) the User Content does not infringe or misappropriate any third party’s intellectual property, privacy, or other rights; and (d) the User Content does not contain unlawful, defamatory, obscene, or harmful material.

10.4 Moderation. PicsArt may, but is not obligated to, review, edit, refuse, or remove any User Content at its sole discretion and without prior notice.

10.5 Prohibited Conduct. When accessing or using the Shop, Customer shall not:

  • Use the Shop for any unlawful purpose or in violation of any applicable law or regulation;
  • Submit fraudulent Orders, false identity information, or stolen payment credentials;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Shop, its servers, or connected networks;
  • Scrape, crawl, or extract data from the Shop by automated means, except through lawful search-engine indexing;
  • Transmit viruses, malware, or other harmful code;
  • Infringe PicsArt’s or any third party’s intellectual property or proprietary rights;
  • Engage in abusive, threatening, or harassing behavior toward PicsArt personnel or other users;
  • Provide materially false or misleading information in connection with any Order, return, or communication;
  • Circumvent any security, access-control, or purchase-limit measures; or
  • Engage in unauthorized commercial exploitation, including bulk purchasing for resale without PicsArt’s prior written consent.

10.6 Remedies. PicsArt may, without liability, suspend or terminate access, cancel Orders, and pursue any available legal remedy in response to any violation of this Section 10.

11. Third-Party Services, Links, and Privacy

11.1 Third-Party Service Providers. The Shop relies on third-party service providers, including Shopify (which hosts the storefront and facilitates checkout), payment processors and payment partners engaged through Shopify, the Fulfillment Provider, shipping carriers, and customs brokers. Each of these providers may operate under its own terms of service, privacy policies, and acceptable-use policies. PicsArt is not responsible for the acts, omissions, or terms of any third-party provider, except that PicsArt remains the seller of the Products and retains all seller obligations owed to the Customer under these Terms and applicable law.

11.2 Third-Party Links. The Shop may contain links to websites or resources operated by third parties. PicsArt does not control, endorse, or assume responsibility for the content, products, or practices of any linked site. Access to any linked site is at the Customer’s own risk.

11.3 Privacy. The collection, use, storage, and disclosure of personal data in connection with the Shop are governed by the Shop Privacy Policy, available at https://store.picsart.com/policies/privacy-policy. In the event of a conflict between these Terms and the Privacy Policy on a privacy-related matter, the Privacy Policy controls.

11.4 Data Sharing with Service Providers. To process, fulfill, and deliver Orders, PicsArt may share Customer order details, contact information, and shipping address with the Fulfillment Provider (which is based in China), shipping carriers, customs brokers, and delivery partners. PicsArt does not make representations regarding the specific security measures employed by these providers but requires them to handle Customer data in accordance with applicable law.

11.5 Payment Data. Checkout and payment processing are handled by Shopify and its payment partners. PicsArt does not store full payment card numbers. Customers should review Shopify’s terms and privacy policy for details on payment data handling.

12. Warranties, Liability Limitations, and Indemnification

12.1 Mandatory Warranties Preserved. Nothing in these Terms excludes, limits, or modifies any warranty, guarantee, right, or remedy that applies under mandatory consumer protection law and that cannot lawfully be excluded or limited. Where such protections apply, PicsArt’s liability is limited to the remedies required by that law.

12.2 Limitation of Implied Warranties. To the maximum extent permitted by applicable law, all implied warranties, conditions, and representations not expressly stated in these Terms or required by mandatory law are excluded. Products are not characterized as provided wholly “as is” where consumer law prohibits such a characterization.

12.3 Exclusion of Certain Damages. To the fullest extent permitted by law, PicsArt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or related to any Order, Product, or use of the Shop.

12.4 Aggregate Liability Cap. Subject to Section 12.5, PicsArt’s total aggregate liability arising out of or in connection with these Terms, any Order, or any Product shall not exceed the greater of (a) USD 100 or (b) the total amount the Customer paid to PicsArt for the affected Order(s) during the six (6) months preceding the event giving rise to the claim.

12.5 Carve-Outs from Liability Cap. The limitations in Sections 12.3 and 12.4 do not apply to liability arising from: (a) fraud or intentional misrepresentation; (b) willful misconduct; (c) death or personal injury caused by negligence where applicable law prohibits limitation; or (d) any mandatory consumer remedy that cannot lawfully be limited or excluded.

12.6 Customer Indemnification. The Customer agrees to indemnify, defend, and hold harmless PicsArt and its officers, directors, employees, and agents from and against any third-party claims, losses, damages, and reasonable expenses (including legal fees) arising from: (a) the Customer’s unlawful misuse of the Shop or Products; (b) infringement of any third-party right by Customer-submitted content; or (c) the Customer’s material breach of these Terms. This indemnity does not extend to any loss, damage, or claim caused by PicsArt’s own act or omission.

13. Dispute Resolution, Arbitration, Governing Law, and Forum

13.1 Governing Law. These Terms and any dispute arising out of or relating to them or the Products shall be governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws of the Customer’s jurisdiction require otherwise.

13.2 ARBITRATION AGREEMENT. PLEASE READ THIS SUBSECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

(a) Scope. Any dispute, claim, or controversy between the Customer and PicsArt arising out of or relating to these Terms, any Order, or the Products (“Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, except as modified herein.

(b) Individual Claims Only; Class and Jury Waiver. All Disputes must be brought in the Customer’s individual capacity. The Customer and PicsArt each waive the right to participate in a class action, collective action, representative action, or private attorney general action. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL.

(c) Small-Claims Carve-Out. Either party may bring an individual action in a small-claims court of competent jurisdiction as an alternative to arbitration, provided the claim falls within that court’s jurisdictional limits.

(d) Intellectual-Property Injunctive Relief. Nothing in this Section 13 prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

(e) 30-Day Opt-Out. A Customer may opt out of this arbitration agreement by sending written notice within thirty (30) days of first accepting these Terms to: store@picsart.com, or by mail to PicsArt, Inc., Optima Onyx Tower, Suite 1103, 1010 South Federal Highway, Hallandale Beach, FL 33009. The notice must include the Customer’s name, mailing address, email address, and a clear statement of intent to opt out. Opting out does not affect any other provision of these Terms.

13.3 Forum. For any Dispute not subject to arbitration (including where a Customer has validly opted out), the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, subject to mandatory consumer-law provisions that grant the Customer an irrevocable right to bring proceedings in another forum.

13.4 Severability. If any part of this Section 13 is found unenforceable, the remaining parts continue in full force. If the class-action or representative-action waiver in Subsection 13.2(b) is found unenforceable as to a particular claim, that claim (and only that claim) must be severed from arbitration and may proceed in court, while remaining claims proceed in individual arbitration.

13.5 Mandatory-Law Savings Clause. Nothing in this Section 13 limits or waives any rights or remedies that cannot be waived or limited under applicable mandatory law, including mandatory consumer protection statutes of the Customer’s jurisdiction of residence.

14. General Provisions

14.1 Force Majeure. PicsArt shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including carrier disruptions, customs holds, supply-chain shortages, labor disputes, epidemics or pandemics, cyberattacks, governmental actions, sanctions, natural disasters, or utility failures (each, a “Force Majeure Event”). PicsArt will use commercially reasonable efforts to resume performance. If a Force Majeure Event prevents fulfillment of an accepted Order for more than thirty (30) days, PicsArt will offer the Customer a full refund of amounts paid for the affected Order, without prejudice to any mandatory consumer remedies.

14.2 Export Controls, Sanctions, and Anti-Fraud Screening. Customer represents that the Products will not be exported or re-exported in violation of applicable export-control or sanctions laws. PicsArt may screen Orders against restricted-party lists and may cancel any Order that triggers a compliance concern, with a refund of prepaid amounts. PicsArt reserves the right to restrict sales to certain geographic regions.

14.3 Changes to These Terms. PicsArt may modify these Terms prospectively by posting the revised version on the Shop with an updated Effective Date. Where required by applicable law, PicsArt will provide reasonable advance notice of material changes. The Terms in effect at the time a Customer’s Order was placed will govern that Order, except where a change is required by law.

14.4 Assignment. PicsArt may assign or transfer these Terms, in whole or in part, to any affiliate or successor without Customer consent. Customer may not assign any rights or obligations under these Terms without PicsArt’s prior written consent.

14.5 Waiver. No failure or delay by PicsArt in exercising any right under these Terms constitutes a waiver of that right.

14.6 Severability. If any provision of these Terms is held unenforceable, the remaining provisions continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

14.7 Entire Agreement. These Terms, together with the Shop Privacy Policy, and any Order confirmation issued by PicsArt, constitute the entire agreement between the Customer and PicsArt regarding purchases through the Shop and supersede all prior or contemporaneous communications on that subject.

14.8 Headings. Section headings are for convenience only and do not affect interpretation.
